Where as, this is an official statement declaring that Saints Peter & Paul Orthodox Church in Crawford county in the village of Crossingville, Pennsylvania is a Church, which by nature is a non-for-profit private body, with its own governance and not under the jurisdiction of the present de facto marshal government. But solely abiding under the righteousness of God administered by the Archbishop Melchesidek in the jurisdiction of Pittsburgh and Western Pennsylvania.

Where as, this body of living hypostases (natural private persons) Saints Peter & Paul Orthodox Church gathered in Crossingville, Pennsylvania, recognized as a religion under the 1st Amendment of The United States Constitution, is a Church, and no laws are made with respect to this private body Saints Peter and Paul Orthodox Church in Crossingville, Pennsylvania (1st Amendment of the United States Constitution ratified effective December 15, 1791).

Where as, we disclaim the present "501c3" status (IRS EN # XX_XXXXXX3/000) held by this body until this date, as there has been a mistake, and, instead reclaim a "508" status as a Church having no need of application to the IRS (See exhibit below) and further the US Code 508 (A)(1)(a) recognizes this parish by negation (See Exhibit below). For purposes of convenience we will continue to use the “501c3” form for purchases, until another recognition of 508 form can be created for business purposes.

Be it resolved that by this status now expressed and decreed, that all property, deeds, interests and whatsoever held and purchases made by Saints Peter & Paul Orthodox Church of Crossingville, Pennsylvania are Internal Revenue Service, IRS, and State of State, Municipal County, and Township EXEMPT from taxation.

 The Orthodox Church in America has a long history in the United States dating back to 1789, and is non-taxable by this status. Saints Peter and Paul has been an established official parish of the Archdiocese of Pittsburgh and Western Pennsylvania in the Orthodox Church in America since 1920.

 Case law has left the definition to “the common meaning and usage” of the term church. De La Salle v. U.S., 195 F. Supp. 891 (N.D. Cal., 1961).

 US Code:

Sec. 508. — Special rules with respect to section 501c3 organizations

            (a) New organizations must notify Secretary that they are applying for recognition of section 501(c)(3) status

            Except as provided in subsection (c), an organization organized after October 9, 1969, shall not be treated as an organization described in section    501(c)(3) —

 In IRS Publication 526, Charitable Contributions, the IRS once again states that churches are qualified organizations and do not need to apply to the IRS:

 

“You can deduct your contributions only if you make them to a qualified organization. To become a qualified organization, most organizations other than churches and governments, as described below, must apply to the IRS.”

 

“Examples. The following list gives some examples of qualified organizations: Churches, a convention or association of churches, temples, synagogues, mosques, and other religious organizations.”
